Speedy Carriage Express (SCE)

These Terms and Conditions (“Agreement”) govern the provision of logistics, freight transportation,
and delivery services by Speedy Carriage Express (SCE) (“SCE”, “Company”, “we”, “our”, or “us”)
to its customers (“Customer”, “Client”, “you”, or “your”). By engaging SCE’s services, you agree to be bound by these Terms and Conditions.
1. Scope of Services
SCE provides logistics and transportation services including, but not limited to:
- Transportation and delivery of heavy equipment
- Hauling and delivery of shipping containers
- Transportation of large propane tanks of any capacity
- Transportation of generator sets (Genset units)
- Industrial machinery and oversized equipment
- Domestic deliveries
- Commercial and industrial deliveries
All services are subject to operational feasibility, safety standards, and regulatory compliance.
2. Customer Responsibilities
- Provide accurate and complete cargo information including weight, dimensions, capacity, hazard classification, and special handling requirements.
- Ensure goods are properly packaged and secured unless SCE is contracted to do so.
- Obtain and provide necessary permits, escorts, and regulatory approvals unless otherwise agreed in writing.
- Ensure pickup and delivery sites are safe, accessible, and suitable for heavy vehicle access.
Failure to meet these requirements may result in delays or additional charges.
3. Heavy Equipment and Specialized Cargo
Due to the nature of transporting large propane tanks (regardless of size), shipping containers,
generator sets, industrial machinery, and other oversized equipment:
- Additional charges may apply for cranes, rigging, escorts, route surveys, or special permits.
- Delivery schedules may be affected by weather, road restrictions, regulatory approvals, or site readiness.
- The Customer must ensure proper site preparation prior to arrival.
SCE reserves the right to refuse transport or unloading if safety or compliance standards are not met.
4. Pricing and Payment Terms
- Quotations are valid only for the period specified.
- Pricing may vary based on distance, weight, fuel costs, permits, loading complexity, and waiting time.
- Payment is due as stated on the invoice.
- Late payments may incur interest or administrative fees.
- SCE may suspend services for overdue accounts.
5. Delivery Timeframes
Delivery dates are estimates only. SCE is not liable for delays caused by:
- Weather conditions
- Traffic or road closures
- Government restrictions
- Permit delays
- Equipment breakdown beyond reasonable control
- Customer-caused delays
- Force majeure events
Time is not of the essence unless expressly agreed in writing.
6. Risk and Liability
6.1 Risk Transfer
Risk of loss or damage transfers to the Customer upon delivery at the agreed destination.
6.2 Limitation of Liability
SCE’s liability is limited to the declared value of goods (if declared in writing prior to transport) or the standard carrier liability under SCE’s insurance policy.
SCE shall not be liable for:
- Indirect or consequential damages
- Loss of profit or business interruption
- Improper packaging or securing
- Pre-existing defects in equipment
- Ground/property damage due to unsuitable site conditions
6.3 Insurance
Customers are strongly advised to obtain adequate cargo insurance for high-value or oversized shipments.
7. Hazardous Materials and Regulated Goods
- All hazardous materials must be fully disclosed prior to transport.
- Required safety documentation and certifications must be provided.
- Propane tanks and regulated goods must meet applicable transport laws.
- SCE reserves the right to refuse non-compliant shipments.
8. Loading and Unloading
- Customer is responsible for providing suitable personnel and equipment unless otherwise agreed.
- If SCE provides cranes, forklifts, or rigging services, additional charges apply.
- Waiting time beyond agreed limits may incur detention charges.
- SCE may halt operations if unsafe conditions are observed.
9. Cancellations and Rescheduling
- Cancellations must be submitted in writing.
- Cancellation fees may apply if resources have already been arranged.
- Rescheduling is subject to availability and may incur additional costs.
10. Indemnification
The Customer agrees to indemnify and hold harmless SCE from claims or liabilities arising from inaccurate cargo information, regulatory violations, unsafe site conditions, or improper packaging.
11. Force Majeure
SCE shall not be liable for delays or failure due to events beyond its control including natural disasters, government actions, strikes, road closures, or fuel shortages.
12. Governing Law
This Agreement shall be governed by applicable laws. Any disputes arising out of or in connection with this Agreement shall first be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation, the parties agree to proceed to mediation or arbitration as mutually agreed.
13. Claims Procedure
- Claims must be submitted in writing within [7–14] days of delivery.
- Supporting documentation (photos, inspection reports, delivery receipts) must be provided.
- Failure to notify within the required timeframe may void the claim.
14. Severability
If any provision is found unenforceable, the remaining provisions remain in full force and effect.
15. Amendments
SCE reserves the right to update these Terms at any time. The latest version will be made available through official company channels.
16. Entire Agreement
These Terms constitute the entire agreement between Speedy Carriage Express (SCE) and the Customer and supersede prior agreements or understandings.
